In execution of a deed of trust, John Grosso, Sr., dated September 12, 2017, recorded in the Clerk’s Office of the Circuit Court of the City of Hampton as instrument 170011668, Douglas E. Plocki, Esq. and Eugene J. Benick, Esq, the undersigned substitute trustees, either of whom may act, will offer for sale at public auction at the front entrance of the Circuit Court for the City of Hampton, Virginia located at 237 N. King Street, Hampton, VA 23669 on the 4th day of October, 2018 at 11:00 AM, the property described in said deed of trust, located at the above address and briefly described as: 

ALL THAT CERTAIN lot, piece or parcel of land with improvements and appurtenances thereunto belonging, lying, being and situate in the City of Hampton, Virginia, containing 0.93 acre, more or less, and being shown and designated “PARCEL ‘B’ 0.93 +/-AC.,” on that certain plat entitled,, “PLAT OF THE PROPERTY OF CARROLL W. WALKER and LORETTA WALKER PARCEL “A” (44.760 +/- S.F.) -1.03 +/- AC. PARCEL ‘B’ (40.600 +/-  S.F.) -0.93 +/- AC. BEING PART OF LOT 7 and LOT  8, BLOCK 1 WHITEHOUSE PRESTON TRACTS CITY OF HAMPTON, VIRGINIA” which plat is dated October 8, 2004, and prepared by Thomas J. Savage, Jr., Surveyor and Land Planner, and a copy of which is attached to and recorded with Deed at Instrument 040033402.

The property will be sold in “AS IS, WHERE IS” condition, without recourse. The property is sold to the purchaser subject to all superior conditions, easements, liens, covenants, assessments, any law suits at law or equity, restrictions of record, agreements of record, and subject to the rights of the occupants, if any. The property is also sold to the purchaser subject to the right of redemption periods for any IRS and Department of Justice liens, if applicable. Neither the trustees, nor the noteholder, nor their respective agents, successors, and assigns make any representations or warranties, expressed or implied, with respect to the property or the improvements located thereon, or any tenancies or parties in possession. Purchaser shall be responsible for obtaining physical possession of the property. 

TERMS OF SALE: ALL CASH. A bidder’s deposit of $10,000 or ten percent (10%) of the sale price, whichever is lesser, will be required in the form of a certified or cashier’s check. Settlement within fifteen (15) days, otherwise deposit may be forfeited. Time is of the essence. The risk of loss from casualty or otherwise, as well as all liabilities of the ownership of the property, shall pass to the purchaser at the conclusion of the bidding. Except for Virginia Grantor tax, all settlement costs and expenses are purchaser’s responsibility. Taxes are prorated to the date of sale. If purchaser defaults, deposit may be forfeited and property resold at the risk and cost of the defaulting purchaser who shall be liable for any deficiency in the purchase price and all costs, expenses and attorney’s fees of both sales. Without forfeiting the deposit, the trustee may avail itself of any legal or equitable means against the defaulting purchaser. If the trustee does not convey title for any reason, purchaser’s sole remedy is return of deposit without interest, plus $1.00. This sale is subject to post-sale audit of the status of the loan secured by the deed of trust, including but not limited to determining whether prior to sale a forbearance, repayment, or other agreement was entered into, the loan was reinstated or paid off, or whether the property became subject to an automatic stay under the U.S. Bankruptcy Code prior to the sale; in any such event this sale shall be subject to cancellation and purchaser’s sole remedy shall be return of deposit without interest, plus $1.00.
